Bu \u00f6zellikle ge\u00e7erli vizesi veya ba\u015fka bir oturma izni olmayan ki\u015filer i\u00e7in ge\u00e7erlidir. Bu t\u00fcr durumlarda, Federal Polis (Bundespolizei) giri\u015fi reddedebilir. Mevcut bir giri\u015f yasa\u011f\u0131 tespit edilirse veya giri\u015f ko\u015fullar\u0131 sa\u011flanmam\u0131\u015fsa, hemen geri \u00e7evirme i\u015flemi uygulan\u0131r. Cevap, Oturma Yasas\u0131\u2019n\u0131n (AufenthG) 11. maddesinin 4, 5, 5a ve 5b f\u0131kralar\u0131nda d\u00fczenlenmi\u015ftir. Bu yasak, kanun sayesinde do\u011frudan uygulan\u0131r. Oturum hukukuna ayk\u0131r\u0131l\u0131\u011f\u0131n ciddiyeti ne kadar b\u00fcy\u00fckse veya kamu g\u00fcvenli\u011fi ve d\u00fczeni i\u00e7in tehdit ne kadar y\u00fcksekse, yasak da o \u00f6l\u00e7\u00fcde uzun s\u00fcreli olarak belirlenebilir. <\/p>\n\n<p>Genel olarak, giri\u015f yasa\u011f\u0131n\u0131n s\u00fcresi be\u015f y\u0131l\u0131 a\u015fmamal\u0131d\u0131r (\u00a7 11 Abs. 3 Satz 2 AufenthG). Ancak, ki\u015fi \u00e7\u0131k\u0131\u015f y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmedi\u011fi i\u00e7in s\u0131n\u0131r d\u0131\u015f\u0131 edilmi\u015fse, makamlar genellikle yasa\u011f\u0131 \u00fc\u00e7 ila be\u015f y\u0131l olarak belirler. <\/li>\n\n\n\n<li><strong>A\u011f\u0131r ihlallerde<\/strong>, \u00f6rne\u011fin i\u015flenmi\u015f su\u00e7lar nedeniyle \u00fclkeden \u00e7\u0131kar\u0131lma veya ki\u015finin kamu g\u00fcvenli\u011fi ve d\u00fczeni i\u00e7in ciddi bir tehdit olu\u015fturmas\u0131 halinde, s\u00fcre \u00a7 11 Abs. 5 AufenthG uyar\u0131nca on y\u0131la kadar \u00e7\u0131kar\u0131labilir. <\/li>\n\n\n\n<li><strong>\u00d6zellikle a\u011f\u0131r vakalarda<\/strong>, \u00f6rne\u011fin bir yabanc\u0131 bar\u0131\u015fa kar\u015f\u0131 su\u00e7, sava\u015f su\u00e7u veya insanl\u0131\u011fa kar\u015f\u0131 su\u00e7 i\u015fledi\u011fi ya da Almanya Federal Cumhuriyeti\u2019nin g\u00fcvenli\u011fi i\u00e7in tehdit olu\u015fturdu\u011fu gerek\u00e7esiyle \u00fclkeden \u00e7\u0131kar\u0131lm\u0131\u015fsa, giri\u015f yasa\u011f\u0131 \u00a7 11 Abs. 5a AufenthG uyar\u0131nca 20 y\u0131l olarak belirlenir. Burada s\u00f6z konusu olan bir azami s\u00fcre de\u011fil, d\u00fczenli olarak \u00f6ng\u00f6r\u00fclen s\u00fcredir. Ancak, bir \u00fcst eyalet makam\u0131 somut vakay\u0131 incelemi\u015fse, istisnai durumlarda s\u00fcre k\u0131salt\u0131labilir (\u00a7 11 Abs. 5a Satz 4 AufenthG).   <\/li>\n\n\n\n<li><strong>\u00d6zel istisnai durumlarda<\/strong>, \u00f6rne\u011fin bir yabanc\u0131 \u00a7 58a AufenthG uyar\u0131nca, \u00fcst eyalet makam\u0131n\u0131n incelemesi sonucunda Almanya Federal Cumhuriyeti\u2019nin g\u00fcvenli\u011fi i\u00e7in \u00f6zel bir tehlikeyi veya ter\u00f6rist\u00e7e faaaliyetlerle olu\u015fabilecek tehdidi bertaraf etmek amac\u0131yla s\u0131n\u0131r d\u0131\u015f\u0131 edilmi\u015fse, \u00a7 11 Abs. 5b Satz 1 AufenthG uyar\u0131nca s\u00fcresiz giri\u015f yasa\u011f\u0131 da m\u00fcmk\u00fcn olabilir. Benzer \u015fekilde, bir yabanc\u0131 bar\u0131\u015fa kar\u015f\u0131 su\u00e7, sava\u015f su\u00e7u veya insanl\u0131\u011fa kar\u015f\u0131 su\u00e7 nedeniyle \u00fclkeden \u00e7\u0131kar\u0131lm\u0131\u015fsa ya da Almanya\u2019n\u0131n g\u00fcvenli\u011fi i\u00e7in tehdit veya ter\u00f6rist\u00e7e faaliyetler ile tehlike olu\u015fturuyorsa da ayn\u0131 h\u00fck\u00fcm ge\u00e7erlidir.  <\/li>\n<\/ul>\n\n<p>Bunun yan\u0131 s\u0131ra e\u011fer yabanc\u0131, Oturma Yasas\u0131\u2019n\u0131n (AufenthG) 54. maddesi 1. f\u0131kras\u0131 1, 2 veya 2a numaral\u0131 bentlerinde belirtilen s\u0131n\u0131r d\u0131\u015f\u0131 edilme gerek\u00e7eleri nedeniyle \u00fclkeden \u00e7\u0131kar\u0131lm\u0131\u015fsa s\u00fcresiz giri\u015f yasa\u011f\u0131 da m\u00fcmk\u00fcnd\u00fcr. Bu \u015fu durumlar\u0131 kapsar:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u00a7 54 Abs. 1 Nr. 1 AufenthG: Ceza hukuku kapsam\u0131nda mahk\u00fbmiyet ve g\u00fcvenlik g\u00f6zetimi ya da \u00a7 63 StGB uyar\u0131nca psikiyatri klini\u011finde zorunlu tedaviye yerle\u015ftirilme. <\/li>\n\n\n\n<li>\u00a7 54 Abs. 1 Nr. 2 AufenthG: \u00d6zg\u00fcrl\u00fck\u00e7\u00fc demokratik temel d\u00fczeni veya Almanya Federal Cumhuriyeti\u2019nin g\u00fcvenli\u011fini tehlikeye atma (\u00f6rne\u011fin yabanc\u0131n\u0131n bir ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olmas\u0131 ya da \u00fcye olmu\u015f olmas\u0131). <\/li>\n\n\n\n<li>\u00a7 54 Abs. 1 Nr. 2a AufenthG: Almanya Federal Cumhuriyeti\u2019nin g\u00fcvenli\u011fini tehlikeye atma (\u00f6rne\u011fin yabanc\u0131n\u0131n \u00a7 129 StGB anlam\u0131nda bir \u00f6rg\u00fcte \u00fcye olmas\u0131 ya da \u00fcye olmu\u015f olmas\u0131). <\/li>\n<\/ul>\n\n<p>Bu durumlarda da, giri\u015f yasa\u011f\u0131n\u0131n s\u00fcresinin k\u0131salt\u0131lmas\u0131 sadece bir \u00fcst eyalet makam\u0131n\u0131n bu y\u00f6nde karar vermesi halinde m\u00fcmk\u00fcnd\u00fcr (\u00a7 11 Abs. 5b Satz 3 AufenthG).<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"befristung-erfolgt-durch-verwaltungsakt\">S\u00fcre S\u0131n\u0131rlamas\u0131n\u0131n \u0130dari \u0130\u015flemle Belirlenmesi<\/h3>\n\n<p>Yetkili yabanc\u0131lar dairesi, giri\u015f yasa\u011f\u0131n\u0131 genellikle \u00fclkeden \u00e7\u0131karma veya s\u0131n\u0131r d\u0131\u015f\u0131 etme i\u015flemiyle ba\u011flant\u0131l\u0131 olarak yaz\u0131l\u0131 bir karar ile s\u00fcreyle s\u0131n\u0131rland\u0131r\u0131r. S\u00fcre, kural olarak, ki\u015finin Almanya\u2019dan fiilen ayr\u0131lmas\u0131yla ba\u015flar. E\u011fer ilgili ki\u015fi \u00fclkeyi g\u00f6n\u00fcll\u00fc olarak terk etmez ve zorla s\u0131n\u0131r d\u0131\u015f\u0131 edilirse, s\u00fcre s\u0131n\u0131r d\u0131\u015f\u0131 edilme tarihiyle ba\u015flar. Ki\u015fi \u00fclkeyi hi\u00e7 terk etmez, aksine \u00fclkede gizlenir veya makamlardan ka\u00e7ar, ise bu durum s\u00fcrenin ba\u015flamas\u0131n\u0131 geciktirebilir hatta tamamen engelleyebilir. Yetkili makamlar\u0131n yasa gere\u011fi bir s\u00fcre s\u0131n\u0131r\u0131 koyma zorunlulu\u011fu vard\u0131r.
